This website uses features of Google DoubleClick. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland, (hereinafter “DoubleClick”).

DoubleClick is used to show you interest-based ads across the Google Network. Advertisements can be tailored to the interests of the viewer using DoubleClick. For example, our ads may appear in Google search results or in banners associated with DoubleClick.

To be able to display interest adequate promotional content to users, DoubleClick must recognize the respective visitor so that it can allocate the websites visited, the clicks and other user pattern information to the user. YouTube

8. Online-based Audio and Video Conferences (Conference tools) 

Data processing

We use online conference tools, among other things, for communication with our customers. The tools we use are listed in detail below. If you communicate with us by video or audio conference using the Internet, your personal data will be collected and processed by the provider of the respective conference tool and by us. The conferencing tools collect all information that you provide/access to use the tools (email address and/or your phone number). Furthermore, the conference tools process the duration of the conference, start and end (time) of participation in the conference, number of participants and other “context information” related to the communication process (metadata).

Furthermore, the provider of the tool processes all the technical data required for the processing of the online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker and the type of connection.

Should content be exchanged, uploaded or otherwise made available within the tool, it is also stored on the servers of the tool provider. Such content includes, but is not limited to, cloud recordings, chat/ instant messages, voicemail uploaded photos and videos, files, whiteboards and other information shared while using the service.

Please note that we do not have complete influence on the data processing procedures of the tools used. Our possibilities are largely determined by the corporate policy of the respective provider. Further information on data processing by the conference tools can be found in the data protection declarations of the tools used, and which we have listed below this text.

 

Purpose and legal bases

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 para. 1 sentence 1 lit. b GDPR). Furthermore, the use of the tools serves to generally simplify and accelerate communication with us or our company (legitimate interest in the meaning of Art. 6 para. 1 lit. f GDPR). Insofar as consent has been requested, the tools in question will be used on the basis of this consent; the consent may be revoked at any time with effect from that date.

 

Duration of storage

Data collected directly by us via the video and conference tools will be deleted from our systems immediately after you request us to delete it, revoke your consent to storage, or the reason for storing the data no longer applies. Stored cookies remain on your end device until you delete them. Mandatory legal retention periods remain unaffected.

We have no influence on the duration of storage of your data that is stored by the operators of the conference tools for their own purposes. For details, please contact directly the operators of the conference tools.

Use of "Zoom" to conduct webinars

*Please note: This is a translation. The information about the usage of “Zoom” in German language is legally binding.*

For our webinars we use the software "Zoom Meetings", a solution of the company Zoom Video Communications, Inc.

With the current decision of the European Court of Justice ("Schrems II ruling" C- 311/18), the transfer of personal data via servers that are not operated within the EU is declared unsafe due to the ineffectiveness of the previous EU-US Privacy Shield. 

However, according to the principles of the EU Data Protection Basic Regulation, any processing of personal data requires a legal basis. Therefore, if a legal data transfer to the USA is to take place, the legal basis for this, according to Art. 49 para. 1 letter a DSGVO, is your consent according to Art. 6 para. 1 letter a DSGVO in connection with Art. 7 DSGVO

Therefore we need your consent to use "Zoom" for the webinar.

 

For your information

Despite the agreement concluded by us with Zoom Video Communications, Inc. on the data protection obligations for order data processing, including standard data protection clauses, it is possible that these regulations may not represent a sufficient means of ensuring the effective protection of personal data transmitted to the USA in practice.  

This is particularly the case because the U.S. authorities are permitted to carry out surveillance activities, which in practice take the form of mass surveillance of communications by secret services.  

 

Voluntary nature of your consent

Your consent to use "Zoom" is given on a voluntary basis. There will be no additional costs and no further consequences if you do not agree.

 

Revocability of your consent

You can revoke your consent at any time and without giving reasons with effect for the future. Your revocation has the consequence that upcoming webinars to which you have already given your consent will not take place via "zoom". Your revocation must be in text form (an e-mail to web-session@marbach.com is sufficient).    

 

Your rights  

As a person affected by data processing in connection with the use of "Zoom" and the implementation of webinars, you have extensive rights. These can be found in detail in our data protection declaration.  

 

Notes on the use of Zoom

In the following we would like to give you some information about our webinar software Zoom and hints for its use. Please read the information carefully and take it into account when planning, conducting and/or participating in zoom meetings.

 

What is Zoom?

Zoom Video Communications is a U.S.-based company based in San Jose, California that provides video conferencing, online meetings, chat and mobile collaboration. Marbach uses this solution to conduct online trainings / webinars.

 

Which data does Zoom collect?

Zoom collects the following technical data on devices, network and Internet connection

  • IP address, MAC address, other device IDs (UDID), device type, operating system type and version, client version, camera type, microphone or speaker, type of connection, 
  • Approximate position (no exact location information), nearest city
  • User behavior (no content from meetings and chats)
  • VoIP or phone call, mobile client or desktop
  • Selected settings in Zoom
  • Participation without video, request meeting password 
  • Duration of the meeting, e-mail address, name or other data that a participant enters to identify him or herself in the meeting, 
  • Start and end time of participants' participation, name of the meeting, planned date / time of the meeting, 
  • Chat status and content (unless the user actively selects a setting)

 

Where is this data transmitted and stored?

Zoom Video Communications, Inc. https://zoom.us/, which operates the Zoom video conferencing platform, processes personal data on our behalf.  This means that Zoom may only use it in accordance with our instructions and not for its own purposes, i.e. neither for advertising nor to pass it on to third parties. The data is stored on systems in the USA

 

Are recordings in zoom allowed?

Recordings are only allowed by Marbach as webinar provider and host. Recording is only allowed with the consent of the participants. As soon as the host starts a recording, the participants will receive an automated pop-up notification asking for the consent of the participants. The host is responsible for the recordings.

Participants who do not agree with the recording are recommended to leave the zoom meeting without giving reasons. Recordings are stored on the host's local computer and not in the Zoom Cloud.

 

What do you have to consider when using Zoom?

Meeting passwords are used and if a recording of the webinar is planned, this will be communicated to participants when they register.

Participants of Zoom meetings can also deactivate their video image for better performance. Participants must not be required to activate the video image.

We have generally deactivated the "attention tracking" function for all participants.

Due to the recently published security vulnerabilities in Zoom, we do not recommend its use on smartphones as the end-to-end encryption does not yet work for phone calls.

9. Custom Services

Job Applications

We offer website visitors the opportunity to submit job applications to us (e.g. via e-mail, via postal services on by submitting the online job application form). Below, we will brief you on the scope, purpose and use of the personal data collected from you in conjunction with the application process. We assure you that the collection, processing and use of your data will occur in compliance with the applicable data privacy rights and all other statutory provisions and that your data will always be treated as strictly confidential.

 

Scope and purpose of the collection of data

If you submit a job application to us, we will process any affiliated personal data (e.g. contact and communications data, application documents, notes taken during job interviews, etc.), if they are required to make a decision concerning the establishment or an employment relationship. The legal grounds for the aforementioned are § 26 New GDPR according to German Law (Negotiation of an Employment Relationship), Art. 6 Sect. 1 lit. b GDPR (General Contract Negotiations) and – provided you have given us your consent – Art. 6 Sect. 1 lit. a GDPR. You may revoke any consent given at any time. Within our company, your personal data will only be shared with individuals who are involved in the processing of your job application.

If your job application should result in your recruitment, the data you have submitted will be archived on the grounds of § 26 New GDPR and Art. 6 Sect. 1 lit. b GDPR for the purpose of implementing the employment relationship in our data processing system.

Data Archiving Period

If we are unable to make you a job offer or you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6 para. 1 lit. f GDPR) for up to 6 months from the end of the application procedure (rejection or withdrawal of the application). Afterwards the data will be deleted, and the physical application documents will be destroyed. The storage

serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the expiry of the 6-month period (e.g. due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your agreement (Article 6 (1) (a) GDPR) or if statutory data retention requirements preclude the deletion.
